The election was held on August 17th, and four days later I learnt that I had not been put into Parliament. I had been on the UPFA National List, which I gathered had been with the approval of both factions of the SLFP. But it had become clear almost immediately that happened that the polarization that was taking place would leave no room for anyone trying to hold a balance.

I had not been able, before it was submitted, to see the President to check about whether I would be on the List. But I did see him on July 14th, along with Faizer Mustapha, who had also resigned as a State Minister early in the year, deeply upset that as the leading Muslim in the SLFP who had supported the President’s campaign he had not been put into the Cabinet. The President told us that he had been responsible for ensuring that we were on the list, and we thanked him, but Faizer was much more worried about the fact that he was low down on the list, and kept questioning the President about his chances of being nominated to Parliament.

Maithripala, with a touch of the gentle irony I had found attractive in my few dealings with him, noted that he had thought we had come to thank him, not to complain. But Faizer was not to be deterred in pressing his case, and proceeded to claim that the Rajapaksa camp was deeply hostile to him because of his devotion to the President. I found this odd, given that Faizer had been one of those who crossed over to support Sirisena only when it became clear that he had a chance of winning, and when it was obvious that the Muslims would vote for him en masse and the Muslims who remained in the Rajapaksa camp had, for the moment, no prospect of political success.

But it was precisely those who crossed over late, in pursuit of their own advantages, who had to convince the President of their undying loyalty. They had nothing else to put forward, since obviously they had no commitment to the principles on which for instance Vasantha Senanayake and I had moved to support Sirisena – having previously, unlike others in government with a few honourable exceptions, raised questions with Mahinda Rajapaksa when we thought his government was going astray. Back in Colombo in early April, I went ahead and introduced my proposed 23rd and 24th amendments to the Constitution. During the previous year Vasantha Senanayake and I had discussed proposing some changes, since we felt we had an obligation to make clear the need for reform. He had put forward a Bill then to reduce the size of the Cabinet and was astonished at the reaction. Apart from strong arm tactics from Basil, the President had called him in and told him he was being unduly influenced by me, which made him indignant given his long family commitment to democratic politics. Twice then he withdrew the Bill or rather, as he affirmed since he did not want to close the door completely, postponed it.

With the change of government we had hoped those who had professed commitment to good government would take our proposed reforms on board,  but we soon realized they had no interest in details, and those in charge were keen only to transfer power to the Prime Minister. We ourselves were hamstrung by the fact that we were part of the executive and could not therefore move Private Bills, but when I resigned I was free of this constraint. Unfortunately Vasantha had by then passed on the ownership of his Bill to the JVP, which having agreed to move it promptly reneged on the commitment – and I was then unable to move such a Bill myself since only one Bill on a particular subject could be entertained at any one time.

But with some help from the Bills Office I put forward two Bills and presented them in Parliament on April 9th. One was about Electoral Reform, and the other was a principle I thought essential for an independent Public Service, namely that Permanent Secretaries be appointed by the Public Service Commission, not the President. Both Bills were seconded by Pabha, the actress who had been elected on the UNP list for Gampaha, but who had then crossed over in the mass defection to the government that took place early in 2007. She understood little about politics, but was keen to learn, and had an intrinsic commitment to democratic governance. Read the rest of this entry »

The manifesto was launched at a ceremony at Vihara Maha Devi Park on December 19th. That was my grandmother’s birthday, and I thought, when I went to the cemetery afterwards, that she would have been pleased that I was working together with Ranil. At the same time, though I realized that was essential, and UNP support was of the essence if Maithripala Sirisena were to win, it was also clear that the UNP itself was in shambles, and had little capacity for effective coordination.

I had sensed this in the decline of Mangala Samaraweera, whom I had thought of as one of the more sophisticated members of the UNP. He had been instrumental in getting Vasantha Senanayake to be the first member of the government to announce publicly that he would not support Mahinda Rajapaksa, though sadly for Vasantha he ignored the request that the Press Conference be held at an independent venue. Mangala instead dragooned Vasanth into making his announcement at Siri Kotha, which led to him being identified with the UNP, which had never been Vasantha’s intention. That was taken ruthless advantage of later to cut him down, tragically for both President Sirisena and also for the UPFA, which he could have contributed to immeasurably.

Twice after the common candidature was announced, Vasantha took me to see Mangala. But instead of the bright strategist I had assumed I would find, I had to deal with an amiable drunk, who wanted nothing better than to gossip over a drink, and then another. After the second such evening, in his delightful house in Ratmalana, I realized that this was yet another broken reed, his period out of power having deprived him of the capacity to focus which he had displayed earlier as a Minister.

qrcode.31254677I was asked recently in an interview to mention seven areas of priority for the new Parliament. I began with Education and Reconciliation which have long been priorities for me. But then I also noted some other areas in which structural change was essential.

One of these was providing greater autonomy to the regions and local bodies with regard to decision making. But I did not by this mean a return to the old debate about devolution and sharing power between the Centre and Provincial governments. My stress was on more power to local bodies, and I also thought it vital to develop better consultation mechanisms.

I am glad that the UPFA manifesto notes this need, and I hope they will study the progress made in this area by the Ministry of Public Administration, working in collaboration with UNDP. A couple of years back the Ministry Secretary sent out a circular about regular meetings at Grama Niladhari level, and he also issued, together with the Secretary for Child Development and Women’s Affairs, a circular setting up Women and Children’s Units in each Division. Building on such initiatives, there was an excellent report prepared by Asoka Gunewardena on improving Service Delivery in the Divisions. This should be used to flesh out the manifesto, leading I hope to fulfilment of the President’s commitment in his January manifesto that ‘The Divisional Secretariat will be made the chief unit that performs the priority tasks of the area’.

qrcode.30640274In the last few articles in this series, before we know whether or not the Reforms this country needs will be taken forward or not, I will continue to look at the pledges in the President’s manifesto which have been ignored. The most important had to do with structural and political reforms, and of these the Government only bothered about one, leaving half a dozen undone.

But there were also very practical measures, which are equally important if we are to develop as our people deserve. Way back in the seventies the Economist I think described us as the only underdeveloped country that was still under-developing, and in 2001, the then Australian ambassador said he had never known a country go backwards so quickly, as we had done, during the period he had been here. That was one reason that motivated me to vote for the UNP in the December Election, though the way the LTTE ran circles round the government that took over soon caused worry. Still, I think it was a good thing we had a change then, since I think it also put the SLFP, in its PA incarnation which then changed to UPFA, back on its toes.

Development, when he experienced it, came largely through construction, as with D. S. Senanayake and his dams, the Mahaweli in JR’s time, and then the devotion to infrastructural development in rural areas under both Premadasa and Mahinda Rajapaksa. But while we must continue grateful to the last, both for bringing us security, and for his development programmes, in the last couple of years it became clear that not enough was being done with regard to Human Resource Development.

Since the change of government, in January consequent to Rajapaksa’s defeat, some of those, who had switched their allegiance to the then common presidential candidate, Maithripala Sirisena deserted the new administration. Having joined Yahapalana project, late last November, Liberal Party Leader and State Minister of Higher Education, Prof. Rajiva Wijesinha, quit the administration in March. The UPFA included Prof. Wijesinha, in its National List submitted to the Elections Secretariat on July 13, hence making him a key element in Rajapaksa’s team.

qrcode.30377434Last week Parliament debated an Adjournment Motion introduced by Mr Yogarajan, one of the more thoughtful members on the government side of the house. He wanted more consultation of political parties and interested groups with regard to electoral reform.

This is an admirable idea, but it is significant, sadly so, that he should have proposed this only in June. As I have pointed out previously, the President’s manifesto said very clearly that on Wednesday January 28th ‘An all party committee will be set up to put forward proposals to replace the current Preference Vote system and replace it with a Mixed Electoral System that ensures representation of individual Members for Parliamentary Constituencies, with mechanisms for proportionality.’

Nothing of the sort was done, so it was surprising to hear the gentleman who seconded the motion claiming that the government had fulfilled almost all its promises. In essence, the process of consultation that the minor parties are pushing for now is something they should have urged as soon as the government was elected.

Former UPFA MP Rajiva Wijesinha says the next parliament should take up a special parliamentary report that dealt with alleged Central Bank bond scam.

The report shouldn’t be allowed to be suppressed; the outspoken former MP said, adding that the new parliament should take a fresh look at the alleged scam.

Parliament will meet again on September 1.

The Liberal Party leader represented the 13-member committee chaired by the then MP and General Secretary of the Communist Party D.E.W. Gunasekera, Chairman of the Committee on Public Enterprises (COPE).

The State Minister for Higher Education Professor Rajiva Wijesinha maintains that the promises made during the presidential campaign period have taken a backseat with the general elections in the offing. At an interview with the Dailymirror Prof. Wijesinha was candid on the reasons that led to his resignation, on the reforms he planned in the higher education sector. He has expressed negative views on the progress of the 100-day programme of the new government.Excerpts of the interview follow.

Q. Was it solely the resignation of the UGC Chairman – a subject on which you claim you weren’t consulted – that led to your resignation from your portfolio?

Last week I attended the portrait unveiling of Mr. Kadirgamar at the Peradeniya University. One of the first questions directed at me by an academic was why I was defending this lady (UGC Chairperson). I said I’m not defending her because no-one has attacked her. But we are here for good governance and a lot of principles have been violated.

“Appointing the Cabinet and ministers was  delegated to Ranil and Chandrika. Chandrika took care of HER SLFP while Ranil simply did  what he had to do: look after the interests of the UNP”

KabirHashimThe first principle on which my resignation was based was a simple one –  if someone is in charge of a subject and you are their superior, you do not interfere [with what they do in office]. When I was appointed as a State Minister I registered my disappointment with the President, but said I would continue to work because it was an interesting subject.

But, one week later, Kabir Hashim was appointed the Cabinet Minister and he told me that even he was not informed of it [ appointment] beforehand. But he told me that he did not have time to look into ministry matters since he would be busy with election work and for me to take on the responsibilities.

However, on Friday (13) I found that he had been ordering my secretary to do things without telling me. I was cross about that. I wrote to him and said it was unethical and that if he wished to get any information he should have asked me.

1423706631_8746526_hirunews_shanikaMeanwhile, I got an e-mail from the UGC Chairperson Professor Kshanika Hirimburegama saying that Minister Hashim had asked her to resign and she thought I knew. I was never consulted on the matter and when I attended work on Tuesday (16) I found she had resigned. I was in a fix because the Act does not give the minister any powers, only responsibilities; and the minister can only act through the UGC. Incidentally, on that day for the first time I discovered prima facie evidence of corruption, which I ordered my secretary to inquire into. The Act states ‘Chairpersons shall work until successors are appointed’; so I informed her to continue work until her position was filled. I was told it might not be a good idea because the FUTA will be annoyed that I’m trying to keep her when I was only trying to get the work done. I decided I cannot operate under such circumstances and  wrote to the President informing I would be resigning with effect from February 17 or to appoint me as the Cabinet Minister for Higher Education. The second reason was due to the demand for the UGC Chair to resign that would result in a violation of the principles of justice. If people make allegations I will definitely investigate them. But I have not received a single official complaint about her.

100 daysQ. Did you make any statement implying  you were against university dons engaging in politics?

During a discussion, in Peradeniya,  I mentioned that we must have systems to stop university officials getting involved in politics. It was decided that perhaps the best step is to have a rule that says university officers don’t have political rights. I never mentioned anything about dons because they have always wanted political rights. They pride themselves in it and why not. They are  brighter and more aware etc. Of course they should engage in politics. You and I know that during the previous regime, Gotabhaya Rajapaksa did wrong when he simultaneously engaged in politics while being a secretary of a ministry. But it was not so clear cut about the UGC Chair because she was not a public official but an academic. Read the rest of this entry »
